These Terms and Conditions govern your use of the Property Nexus Property Jobs Board website and the related products, features, apps, services, technologies and software that Property Nexus Limited (also referred to as “we”) offer (“the Board”).

Services we provide

The Board enables businesses and other members of the UK property industry and the wider public to place and search for job advertisement listings for property industry jobs in the UK. To achieve this, we provide the products and services as part of the Board described below to you:

  • We use the data we have about the job advertisement listings you submit and connections you make, the choices and settings you select, and what you share and do on the Board to personalise your experience.
  • We help you find and connect with people, groups, businesses, organisations and others that matter to you and the job listing you have submitted. We use the data that we have to make suggestions for you and others.
  • We allow you to communicate with other users on the Board – for example, sharing business contact and job listing information, sending messages to another person, business or several people, or adding content to your user and account profile.
  • We show you ads, offers and other sponsored content to help you discover content, products and services that are offered by the many businesses and organisations that use our Board. Our sponsors pay us to show their content to you.
  • We adopt reasonable measures to detect misuse of the Board and if detected we will take appropriate action – for example, removing content, blocking access to certain features, disabling an account or contacting law enforcement.
  • We engage in research and collaborate with others to improve the Board. One way we do this is by analysing the data we have and understanding how people use the Board.
  • The Board helps you find and connect with people, groups, businesses, organisations and others in the UK property industry and the wider public that are interested in your listing and that are important to you.

Privacy

We collect and use your personal data in order to provide the services described above to you. You can learn about how we collect and use your data in our Privacy Policy.

Your obligations when using the Board

When you use the Board you have the following obligations:

(1) Who can use the Board

You must:

  • Use the same name that you use in everyday life.
    • Provide accurate information about yourself and your business and the job being advertised.
    • Create only one account to be used you and your business.
    • Not share your password, give access to your Board account to others or transfer your account to anyone else (without our permission).

You cannot use the Board if:

  • You are under 13 years old.
    • You are a convicted sex offender.
    • We’ve previously disabled your account for breaches of our Terms or Policies.
    • You are prohibited from receiving our products, services or software under applicable laws.

(2) What you can share and do on the Board

You agree not to engage in the conduct described below (or to facilitate or support others in doing so):

  1. You may not use the Board to do or share anything:
  2. That breaches these Terms, and any other terms and Policies that apply to your use of the Board.
    • That is unlawful, misleading, discriminatory or fraudulent.
    • That infringes or breaches someone else’s rights.
  3. You may not upload viruses or malicious code, or do anything that could disable, overburden or impair the proper working or appearance of the Board.
  4. You may not access or collect data from the Board using automated means (without our prior permission) or attempt to access data that you do not have permission to access.

We can remove content that you share in breach of these provisions and, if applicable, we may take action against your account. We may also disable your account if you repeatedly infringe other people’s intellectual property rights.

We encourage you to report content or conduct that you believe breaches your rights (including intellectual property rights) or our Terms and Policies.

(3) Permissions you give us

We need certain permissions from you to provide our services:

  1. Permission to use content that you create and share: You own the content that you create and share on the Board, and nothing in these Terms takes away the rights that you have to your own content. You are free to share your content with anyone else, wherever you want. To provide our services though, we need you to give us some legal permissions to use that content. Specifically, when you share, post or upload content that is covered by intellectual property rights (e.g. photos or videos) on or in connection with the Board, you grant us a non-exclusive, transferable, sub-licensable, royalty-free and worldwide licence to host, use, distribute, modify, run, copy, publicly perform or display, translate and create derivative works of your content (including its host or use as part of the wider Property Nexus Property Network and its websites). You can end this licence any time by deleting your content or account or contacting us in writing to request this. You should know that, for technical reasons, any content that you delete may persist for a limited period of time in backup copies (though it will not be visible to other users). In addition, content you delete may continue to appear if you have shared it with others and they have not deleted it.
  2. Permission to use your listing information, name, your business name and profile picture and information about you and your business’ actions with ads and sponsored content: You give us permission to use your name and your business name and profile picture and information about actions that you or your business have taken on the Board next to or in connection with ads, offers and other sponsored content that we display across our Board (as well as to use this information on the wider Property Nexus Property Network and its websites), without any compensation to you.
  3. Permission to modify any information submitted by you on the Board to take into account any upgrades we make to the Board or to ensure listings on the Board are shown correctly and consistently. For example:

– if we add more specific categories or sub-categories of job listings to the Board then we may move your listing to one of these new categories or sub-categories where we deem this appropriate, or

– if a job listing is submitted to the Board but some of the optional fields relating to listings only are incorrectly completed then we may delete the information submitted in these optional fields to ensure the listing is shown correctly without this information and to ensure the listing is consistent with how other listings are shown on the Board

  • Permission to update software that you use or download: If you download or use our software, you give us permission to download and install upgrades, updates and additional features to improve, enhance and further develop it.

(4) Limits on using our intellectual property

If you use content covered by intellectual property rights that we have and make available in the Board (for example, images, designs, videos or sounds that we provide, which you add to content you create or share on the Board), we retain all rights to that content (but not yours). You can only use our copyrights or trademarks (or similar marks) with our prior written permission. You must obtain our written permission (or permission under an open source licence) to modify, create derivative works of, decompile or otherwise attempt to extract source code from us.

Updating our Terms

We may need to update these Terms from time to time to accurately reflect our services and practices which will be shown on this page on the Board and therefore you should regularly check this page. Once any updated Terms are in effect, you will be bound by them if you continue to use the Board. If you do not agree to our updated Terms and no longer want to be a part of the Board, you can delete your account at any time.

Account suspension or termination

If we determine that you have clearly, seriously or repeatedly breached our Terms or Policies we may suspend or permanently disable access to your account (including deleting or modifying any listings or other information you have published on the Board and any messages sent to other users of the Board). We may also suspend or disable your account (including deleting or modifying any listings or other information you have published on the Board and any messages sent to other users of the Board) if required to do so by law.

Board suspension or termination

We reserve the right in the future to suspend or terminate the Board at any time and for any reason in our absolute discretion. Should we do so, then we may permanently disable and delete your account (including deleting or modifying all listings or other information you have published on the Board and any messages sent to other users of the Board) or we may transfer this account to any replacement version of the Board which we publish.

Limits on liability

We will use reasonable skill and care in providing our Board to you and in keeping a safe, secure and error-free environment, but we cannot guarantee that our Board will always function without disruptions, delays or imperfections. We do not accept responsibility for: losses not caused by our breach of these Terms or otherwise by our acts; losses that are not reasonably foreseeable by you and us at the time of entering into these Terms; any offensive, inappropriate, obscene, unlawful or otherwise objectionable content posted by others that you may encounter on our Board; and events beyond our reasonable control.

We also make no recommendations regarding the quality of service, reputation or otherwise of any businesses or persons who have made listings on our Board, and we accept no liability for any loss or damage arising from this.

Governing law

Your use of the Board will be governed by and construed in accordance with the laws of England and any disputes or claims between you and Property Nexus will be decided only by the Courts of England.
